From the very first day after the due date, a fee of ₹200 per day accrues on the outstanding TDS return under Section 234E. This is not a penalty that kicks in after a notice, it is automatic and mandatory. The only cap is that total 234E fees cannot exceed the total TDS amount in the return.

On top of Section 234E, the Assessing Officer can levy a penalty under Section 271H:

Step 1: Get Your TAN In Order

Every TDS return filing requires a valid TAN, Tax Deduction Account Number, a 10-character alphanumeric identifier issued by the Income Tax Department. If you do not have one, apply via Form 49B on the NSDL portal. Without a TAN, you cannot file a TDS return.

Step 2: Collect Deductee PAN Details

Every deductee entry in your TDS return requires their correct PAN.
